3. Prices

The sale prices indicated on Cap-Nature, Céline Pugin represent the final prices and, unless otherwise stated, include all other legal fees such as anticipated recycling fees (VRG) or copyright fees for electronic devices. As a small business, we are exempt from VAT.

Unless otherwise specified, any shipping costs will be charged separately and must be paid by the customer. Delivery charges are indicated separately in the ordering process.

We reserve the right to make technical changes, errors, and printing mistakes, in particular Cap-Nature, Céline Pugin may change prices at any time and without notice. Consulting and support services are not included in the sales prices.

4. Conclusion of the contract

The products and prices on this site are non-binding offers.

By ordering through this website, including acceptance of these terms and conditions, the customer submits a legally binding offer to conclude a contract. Cap-Nature then sends an automatic order confirmation by email, confirming that the customer's offer has been received by Cap-Nature, Céline Pugin. Orders placed bind the customer. Unless otherwise stated, there is no right of return or withdrawal.

The contract is concluded as soon as Cap-Nature, Céline Pugin sends a declaration of acceptance by email confirming the shipment of the ordered products or services.

Orders are only delivered after full payment has been received (exception: delivery against invoice) and if the goods are available. If it turns out that the ordered goods cannot be delivered or cannot be fully delivered, Cap-Nature, Céline Pugin has the right not to accept or to execute the order or only partially. In such a case, Cap-Nature will inform the customer by email. If Cap-Nature, Céline Pugin has already received payment from the customer, the payment will be refunded to the customer. If payment has not yet been made, the customer is released from the obligation to pay.

5. Payment options and retention of title

The payment options specified in the ordering process are available to the customer.

Cap-Nature, Céline Pugin reserves the right to exclude customers from individual payment options without giving reasons or to require prepayment.

Cap-Nature, Céline Pugin may charge default interest of 5% per year and reminder fees of up to CHF 20 per reminder in case of late payment by the customer.

Products delivered to the customer remain the property of Cap-Nature, Céline Pugin until full payment of the price.

6. Delivery, inspection obligation, defect notification, and returns

Deliveries are made by mail or courier to the address provided by the customer at the time of order. Deliveries are made at the customer's own risk. Cap-Nature, Céline Pugin does not deliver parcels to PO boxes.

Cap-Nature, Céline Pugin strives to keep delivery times as short as possible. Cap-Nature, Céline Pugin is authorized to make partial deliveries. In this case, the customer will only be charged shipping costs once.

The invoice, if delivery against invoice is offered, is sent at the choice of Cap-Nature, Céline Pugin by email or by mail.

If the delivery cannot be made or if the customer refuses to accept the delivery, Cap-Nature, Céline Pugin may terminate the contract after informing the customer by email and respecting a reasonable grace period and charge the costs of the activities.

The customer is required to check the delivered goods immediately after receipt of the delivery and to report any defect for which Cap-Nature, Céline Pugin guarantees immediately in writing by letter or email to the address indicated in the legal notice.

Returns to Cap-Nature, Céline Pugin are made at the customer's expense and risk. The customer must send the goods in their original packaging, with all accessories and accompanied by the delivery note and a detailed description of the defects to the return address indicated by Cap-Nature, Céline Pugin in the legal notice.

If the inspection by Cap-Nature, Céline Pugin shows that the goods have no detectable defects or that these are not covered by the manufacturer's warranty, Cap-Nature, Céline Pugin may charge the customer for the activities, return, or any disposal.

7. Right of withdrawal

The customer has a right of withdrawal of 10 calendar days after receiving the merchandise. The deadline is considered met if the customer sends the written withdrawal by email or mail (address according to legal notice) to Cap-Nature, Céline Pugin within the allotted time. Withdrawal does not require justification.

Exercising the right of withdrawal results in the cancellation of the contract. The customer must return the merchandise in its original packaging within 10 calendar days, complete with all accessories and accompanied by the delivery note to the return address indicated by Cap-Nature in the legal notice. Returns to Cap-Nature, Céline Pugin, are made at the customer's expense and risk. Any payment already made will be refunded to the customer within 20 calendar days in the form of vouchers if Cap-Nature, Céline Pugin has already received the merchandise or if the customer can provide proof of shipment.

Cap-Nature, Céline Pugin reserves the right to claim appropriate compensation for damage, excessive wear, or loss of value due to improper handling and to deduct the reduction in value from the purchase price already paid or to charge the customer.

No right of withdrawal is granted in the following cases:

(i) If the contract includes a random element, especially because the price is subject to fluctuations over which the provider has no influence;

(ii) If the subject of the contract is a movable good which, due to its nature, is not suitable for return or may deteriorate quickly;

(iii) If the subject of the contract is a movable item manufactured according to the customer's specifications or clearly adapted to their personal needs;

(iv) If the contract concerns digital content and this content is not provided on a tangible data carrier or if the contract must be executed immediately and fully by both contracting parties;

(v) If the contract concerns a service and the contract must be fully performed by the provider with the prior express consent of the customer before the withdrawal period expires.

(vi) In the areas of accommodation, transport, food and beverage delivery, and leisure activities, if the provider commits to providing the services at a specific time or within a specific period.

(vii) On items available on order (pre-order) and whose amount exceeds CHF 100.-

(viii) On all discounted items.

8. Warranty

At Cap-Nature, Céline Pugin strives to deliver goods of perfect quality. In case of defects reported in time, Cap-Nature, Céline Pugin guarantees that the item purchased by the customer is free from defects and functional during the legal warranty period, which is generally two years from the date of delivery. It is at the discretion of Cap-Nature, Céline Pugin to provide the warranty through free repairs, equivalent replacements, or by refunding the purchase price. Other warranty rights are excluded.

The warranty does not cover normal wear and tear and the consequences of improper handling or damage caused by the customer or third parties, as well as defects that can be attributed to external circumstances. The warranty on consumables and wear parts (e.g., batteries, accumulators, etc.) is also excluded.

Cap-Nature, Céline Pugin is unable to provide assurances or guarantees regarding the timeliness, completeness, and accuracy of the data as well as the constant or uninterrupted availability of the website, its features, embedded hyperlinks, and other content. In particular, it is not guaranteed that the use of the website will not infringe any third-party rights not held by Cap-Nature, Céline Pugin.

9. Liability

Cap-Nature, Céline Pugin excludes all liability, regardless of its legal basis, as well as claims for damages against Cap-Nature, Céline Pugin and all auxiliary persons and agents. In particular, Cap-Nature, Céline Pugin is not liable for indirect damages and consequential damages caused by defects, loss of profit, or other personal, material, or purely financial damages caused to the customer. Any other mandatory legal liability, for example for gross negligence or illegal intent, remains reserved.

10. Data Protection

Cap-Nature, Céline Pugin may process and use the data recorded in connection with the conclusion of the contract to fulfill the obligations of the purchase contract and use them for marketing purposes. 11. Partial Invalidity

If individual provisions of these terms and conditions prove to be ineffective or unenforceable, or become ineffective or unenforceable, this shall not affect the validity of the remaining provisions.

12. Additional Provisions

Cap-Nature, Céline Pugin expressly reserves the right to modify these terms and conditions at any time and to enforce them without prior notice.

In case of dispute, only Swiss substantive law applies, excluding conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Law) is explicitly excluded.

The competent jurisdiction is Pont-en-Ogoz / registered office of Cap-Nature, Céline Pugin.
