Privacy Policy

1. User data security comes first

Cap-Nature respects the privacy of all users of the website or the online store (hereinafter referred to as "the customer" or "the customers"). These data protection provisions form the basis for the processing of personal data and provide information about the type of user data collected from customers by Cap-Nature, how Cap-Nature uses this data, and the rights to which customers are entitled. Cap-Nature complies with applicable data protection laws and processes personal data only for the purposes for which the data was transmitted.

These data protection provisions are adapted, supplemented, or amended from time to time. At each new call or visit to the website, the current and available version applies.

In case of conflict between this data protection statement and the contractual terms or general conditions of Cap-Nature otherwise applicable, the provisions of this data protection statement shall prevail.

 

2. Nature and purpose of the data collected

The term "personal data" or "personal" within the meaning of this data protection statement includes information by which customers can be personally identified.

Processing of personal data means any processing of personal data, such as collection, use, storage, disclosure, transmission, or deletion of the data.

On the one hand, Cap-Nature automatically collects personal data when the customer interacts with the website or uses the online store. On the other hand, personal data that a customer provides (for example by contacting, creating a user profile, or a customer account) is recorded automatically or manually.

2.1 Automatically collected data

When visiting the Cap-Nature website, statistical data about visitors is automatically collected on the parts of the website visited by the customer. Each time a website is accessed, the web server automatically records a server log file, which contains, for example, the name of the requested file, the client's IP address, the date and time of the request, the browser used, the operating system, the amount of data transferred, and the requesting provider (access data) and documents the call. In this context, it is sometimes necessary to use cookies (see section 4 below).

These access data are evaluated exclusively for the purpose of ensuring smooth operation of the site and improving our offer.

2.2 Data during interaction with Cap-Nature, for contract processing, contact, and opening a customer account

Cap-Nature does not automatically collect customers' personal data such as name, address, phone number, or email address.

On the other hand, personal data is collected from customers if a customer voluntarily provides it as part of an order or when contacting Cap-Nature (for example via a contact form or an email). Mandatory fields are marked as such because Cap-Nature requires the data in these cases to process the contract or to handle the contact, and the contact or order cannot be sent without their details. The data collected can be viewed from the respective input forms.

If a customer decides to open a customer account, Cap-Nature uses the personal data for the purpose of opening a customer account. The mandatory information requested during registration must be fully completed; otherwise, Cap-Nature may refuse the registration. Cap-Nature uses the personal data collected solely for the purpose of using the online store or the corresponding offer or service for which the customer registered. Additionally, Cap-Nature may use the customer's email address to inform them of important changes, for example in the scope of the offer or in case of technically necessary modifications.

Once the contract is fully processed or after the customer account is deleted, the customer's data will be restricted for further processing and deleted after the expiration of the tax and commercial retention periods, unless the customer has expressly consented to further use of the data or Cap-Nature reserves the right to use the data beyond what is permitted by law. Deleting the customer account is possible at any time and can be done either by sending a message to the contact details provided below (see section 9 below) or by using a function provided in the customer account.

 

3. Legal basis for the collection and processing of personal data

The legal basis for the collection and processing of the customer's personal data depends in each individual case on the respective purpose of the data processing. Eligible bases include:

  • the protection of the legitimate interests of Cap-Nature, provided that the interests of the customer or fundamental rights or freedoms are not unduly harmed;
  • the conclusion or execution of a contract; or
  • Customer consent at the time of personal data collection. The customer can revoke their consent at any time. To do so, the customer can send a corresponding message to the contact details described below. The legality of the data processing already carried out is not affected by the revocation.

4. Use of cookies and use of data

4.1 Cookies

In order to continuously improve the website for customers, Cap-Nature may use cookies. Cookies are small software information stored on the customer's computer hard drive by web browsers (e.g., Google Chrome, Internet Explorer, or Mozilla Firefox) to facilitate the use of the website (e.g., language selection, shopping cart, etc.).

Some of the cookies used by Cap-Nature are deleted again at the end of the browser session, that is, after closing the web browser (session cookies). Other cookies remain on the end device and allow Cap-Nature to recognize the customer's web browser on their next visit (so-called persistent cookies). The storage duration can be found in the overview in the cookie settings of the web browser.

Most web browsers automatically accept these cookies, but the web browser can be configured not to accept or save cookies. However, if cookies are disabled, the website's functionality may be limited. You can find details about this in the user manual or in the help function of the web browser.

 

4.2 Use of data

The anonymized data recorded by cookies when accessing the Cap-Nature website may be used for web analysis purposes, to optimize the website, and to measure performance. Cap-Nature may use third-party providers for this, some of whom have their own data protection policies over which Cap-Nature has no influence.

Google Analytics

The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States.

Google evaluates the use of the website to compile reports on website activities and to provide Cap-Nature with other services related to website and Internet usage. The IP address transmitted by the customer's web browser as part of Google Analytics will not be merged with other Google data.

The information generated by the cookies regarding the use of the website is generally transmitted to a Google server in the United States and stored there. Google AdWords and Google conversion tracking

The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States.

As part of Google AdWords, Cap-Nature uses what is called conversion tracking. When the customer clicks on an ad placed by Google, a cookie is set for conversion tracking. These cookies expire after 30 days at the latest and are not used to identify the customer. If the customer visits the Cap-Nature website and the cookie has not yet expired, Google and Cap-Nature can recognize that the customer clicked on the ad and was redirected to this page.

Cap-Nature learns from Google the total number of users who clicked on the ad and were redirected to the website with a conversion tracking tag. However, Cap-Nature does not receive any information that personally identifies the customer.

Google Maps

The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Cap-Nature uses Google Maps for the visual display of geographic information. When using Google Maps, Google transmits or processes data about the use of Maps functions by website visitors, which may include, in particular, the IP address and location data. Cap-Nature has no influence on this data processing.

To the extent that information is transmitted and stored by Google on servers in the United States, the American company Google LLC is registered under the name "Swiss-U.S. Privacy Shield" certified.

To disable the Google Maps service and thus prevent data transmission to Google, a customer must disable the JavaScript function in the web browser. In this case, Google Maps cannot be used or can only be used to a limited extent.

4.3 Social Media Content

Cap-Nature may use social media plugins from social networks such as Facebook, Instagram, or Twitter on the website.

When the customer calls a website containing such a plugin, the web browser establishes a direct connection with the servers of the respective social network. The content of the plugin is transmitted directly to the web browser by the respective provider and integrated into the page. By integrating the plugins, the providers receive the information that the customer's web browser has accessed the corresponding Cap-Nature website, even if the customer does not have a profile on the relevant social network or is not currently logged in. This information (including the IP address) is transmitted directly from the customer's web browser to a server of the respective provider (possibly in the United States) and stored there. If the customer is logged into one of the services, the social network providers can directly assign the visit to the Cap-Nature website to the respective social network profile. If the customer interacts with the plugins, for example using the "Like" or "Share" button, the corresponding information is also transmitted directly to a server of the provider and stored there. The information is also published on the social network and displayed to the customer's contacts.

These social media platforms have their own data protection rules, over which Cap-Nature has no influence.

If the customer does not want to load any of these plugins, it is recommended to log out of the relevant social network. In addition, various web browsers can be configured or supplemented with add-ons (e.g., Facebook blockers) so that social media plugins are not loaded.

 

5. Newsletters

If the customer wishes to receive a newsletter offered by Cap-Nature, Cap-Nature needs the customer's email address and other information to verify that the customer is the owner of the specified email address and the customer's consent to receive the newsletter (so-called "double opt-in" procedure). If the customer wishes to subscribe to a newsletter as a registered customer, they can give their consent at the time of registration or later using the subscription function in the customer account.

With the newsletter, the customer regularly receives recommendations and offers that may interest them. For this purpose, Cap-Nature collects and processes personal data related to the customer's usage behavior on the website, Cap-Nature orders, and how the customer uses the newsletter (for example, whether the newsletter is opened or which web URL links are clicked). Cap-Nature may evaluate this data for statistical purposes to better tailor the newsletter content to customers' interests.

The processing of personal data entered in the newsletter registration form is based on the customer's consent, which the customer can revoke at any time for the future. Revocation can be done either via the "Unsubscribe" link in the newsletter, a written notification by the customer to Cap-Nature at the address indicated below, or by unsubscribing in the customer account. Cap-Nature uses the collected personal data to design the content and send the newsletter. They will not be passed on to third parties for your own purposes (advertising).

Cap-Nature stores the personal data held by the customer for the purpose of receiving the newsletter until the customer unsubscribes from the newsletter.

 

6. Transmission of your data

Cap-Nature will not disclose customers' personal data to third parties. This does not apply if the customer has consented to the data being transmitted to companies not affiliated with Cap-Nature or if Cap-Nature is legally, officially, or judicially obliged to do so. In addition, if service providers who support Cap-Nature in data processing, website administration, or in any other way, as well as in providing the products and services requested by the customer, are involved (for example, parcel delivery or newsletter service providers). These third parties are required to maintain the same level of security and data protection as Cap-Nature.

 

7. Data security

Unfortunately, data transmission over the Internet is not completely secure. Cap-Nature works with service providers and internet providers who take appropriate technical and organizational security measures to protect customers' personal data. However, Cap-Nature cannot guarantee the security of data transmitted by the customer. Any data transfer is therefore at your own risk.

 

8. Your information and right of withdrawal

Of course, every customer is free to inform Cap-Nature at any time - for example by email - that personal data should no longer be used to contact us in the future. Participation in special services on the Cap-Nature website, such as the newsletter service, can also be revoked at any time.

In addition, it is possible to obtain information about data processing or to request a copy of the personal data collected via the Cap-Nature website.
